This Privacy Policy governs the usage of the personal information you submit via the College Committed. All personal information you share is presumed to be given willingly, and is subject to your express consent and understanding. This Privacy Policy, along with the Terms of Service constitute a single, legally binding document between you and College Committed. By accessing and using College Committed, you are hereby compliant and expressly AGREE to all conditions contained in these Privacy Policy, and thus find them reasonable. Furthermore, your behavior on this Service is at ALL times governed and subject to College Committed’ Terms of Service and all auxiliary documents you are given access to, and thereby acquainted with.

We advise you to get acquainted with our Terms carefully before you start to use our Website. By creating an account, visiting or using this website, you conclusively express consent, and agree to be bound to the Terms set forth in this document. Some areas may overlap with other documents, which are part of an entire agreement with you and College Committed. For example, our Privacy Policy may be incorporated in this documents directly or by Reference.

College Committed (thereinafter referred to as: Service) is a platform owned and operated by College Committed LLC, having its primary place of business in the U.S. The owner of this Service is, by all objective standards, a legitimate and legally bound Limited Liability Company, constituted and established under U.S. governing Law and registered in U.S. Company Registry.

You may visit this Service if you are 13 years of age or older. If you are under 13 years of age and are visiting this Website, please stop using this Service. By visiting and using this Service, you hereby represent and warrant that you are of relevant legal age to form a binding contract and meet all foregoing eligibility requirements. If you are between the ages of 13-18, you are required to have a legal guardian supervising and/or allowing you to further use this Service. If you, by any reason whatsoever, do not meet these requirements, you may not access this Service, or access may be denied by the Service within its discretion rights.

College Committed is an open platform, and we do not want any question or issue to be unanswered or unresolved. That is why you may contact us directly in case of any issue whatsoever, via e-mail or contact information stated on this Website.

1. General Provisions

                A. Ownership and Proprietary rights of the Service

This service and software are, in their entirety proprietary to College Committed. As such, they are protected by us copyright, intellectual and other substantial laws, as well as international treaty provisions, you therefore must treat this service and/or software as legally protected material.one is not to rent, sublet, redistribute, sell, timeshare or copy this software’s source code, content or mimic it’s functionality by translating, disassembling, or in any other way, creating derivative works which are based on this unique code, content or functionality pattern, unless stated otherwise in this specific software license agreement and without previous consent from College Committed. College Committed does not guarantee that consent will ever be issued. Violating full ownership rights gives College Committed the right to take any action it deems appropriate, not excluding civil and/or criminal actions being brought up against the individual, group or other third party involved in the violation.

                B. Express Licensing Grant

COLLEGE COMMITTED HEREBY GRANTS YOU A NON-EXCLUSIVE AND NON-TRANSFERRABLE, REVOKABLE LICENSE TO USE THIS WEBSITE AND/OR SOFTWARE. THIS LICENSE IS INTENDED FOR PERSONAL USE ONLY. PERSONAL USE MAY BE REALIZED VIA A STATIC (PERSONAL) OR PORTABLE COMPUTER AND/OR MOBILE DEVICE THAT SUPPORTS THIS WEBSITE AND/OR SOFTWARE. EDUCATIONAL USE IS, AT ALL TIMES, GOVERNED BY THE FERPA ACT, WHICH IS TO BE INCORPORATED IN THIS PRIVACY POLICY EITHER BY A DEDICATED SUBSECTION OR BY REFERENCE.

                C. Account Information

In connection with User Data, as of the date you accepted this Agreement and throughout the term of this Agreement, you represent, warrant and agree that:

  • It is your sole responsibility to withhold the obligations arising from this Section.
  • We may exercise the rights to your User Data granted under this Agreement without liability or cost to any third party; and
  • Your User Data complies with the terms of this Agreement.
     

                D. Anti-Solicitation and Anti-Denigration Statement

As a User of College Committed, You shall withhold of any:

  • solicitation, causing or assisting to any employee, officer, director, agent, admin, commissioner, consultant or helper in:
  • terminating, suspending, discontinuing of employment, consultancy and/or any relationship this person has with College Committed ;
  • becoming employed by, or work for any other person, group or entity other than College Committed ;
  • Make any negative or defamatory statements or comments about College Committed or any of its Representatives, which may result in hurting the reputation, image, ability or goodwill of College Committed or it’s Representatives;
  • solicit or cause an existing or potential Customer to cease using College Committed and it’s provided products and Services or to solicit and cause a potential Customer to use other products or Services, which are competitive with College Committed products and Services;
  • Aid, abet or authorize any person, group or entity in any of the aforementioned.

The site’s content is gathered, modified and published with respect to the Authors (Licensors) in accordance with all applicable U.S. and international intellectual property law standards. College Committed, together with the Authors (Licensors) owns and controls all the copyright and/or other intellectual property rights of the complete content on the Service. All the copyright and/or other intellectual property rights regarding this Service’s full content (including, but not limited to sections of this Service which are or are not available to the general public, registered users, persons with authorized access to specific sections of the Service etc.) are reserved. Unilateral statements voiding partial or full reservation of copyright and/or other intellectual property rights are null and void. Unilateral statements voiding partial or full reservation of copyright and/or other intellectual property rights are null and void. All eventual further licensing and/or transfers of copyright and/or other intellectual property rights regarding the design, Content and/or functionality of this Website can only be transferred via a binding agreement between College Committed, requiring express consent towards the transfer of these rights to third parties upon their previous request, which is made available to this Website’s visitors. The preceding requirements are intended to comply with College Committed’s rights and obligations under the DMCA, including 17 U.S.C. §512(c), but do not constitute legal advice. It may be advisable to contact an attorney regarding your rights and obligations under the DMCA and other applicable laws.

2. Users

              A. Creation of User Profile

You hereby represent and warrant that information you share on this Service is truthful, accurate, non-misleading, and not libelous or defamatory towards another individual or group. Usage of your User Account is your Sole responsibility. We strongly encourage utilizing complex passwords (created using Uppercase and Lowercase letters, special keyboard symbols and numbers). We further advise you not to share your Account information (namely Login Credentials and Password) with anyone, and in event of such breach, to notify College Committed without any unnecessary delays. College Committed takes no responsibility in case of damage or loss due to security breaches caused by negligence or intent of another party.

By providing College Committed your email address you consent to our using the email address to send you Service-related notices, including any notices required by law, analogically with communication by postal mail. We may also use your email address to send you other messages, such as changes to features of the Service and special offers. Some of these set preferences may be changed. For please see the Subsection 3H.

                B. Restrictions

All Users are to Withhold of:

  • Infringement of Copyright or other Proprietary rights (Namely by: Copying, distributing, or disclosing any part of the Service in any medium, including without limitation by any automated or non-automated “scraping”)
  • Taking Any Action that may Cause harm to the Service (without limitation):
  • Using any automated system, including without limitation “robots,” “spiders,” “offline readers,” etc., to access the Service in a manner that sends more request messages to the College Committed servers than a human can reasonably produce in the same period of time by using a conventional web browser
  • Transmitting spam, chain letters, or other unsolicited email or attempting to interfere with, compromise the system integrity or security or decipher any transmissions to or from the servers running the Service;
  • Taking any action that imposes, or may impose at our sole discretion an unreasonable or disproportionately large load on our infrastructure;
  • Uploading invalid data, viruses, worms, or other software agents through the Service;
  • Collecting or harvesting any personally identifiable information, including account names, from the Service;
  • Using the Service for commercial solicitation purposes;
  • Interfering with the proper working of the Service;
     
  • Action that May Cause harm to Users and/or Third Parties (without limitation):
    • Impersonating another person or otherwise misrepresenting your affiliation with a person or entity, conducting fraud, hiding or attempting to hide your identity;
    • Bypassing the measures we may use to prevent or restrict access to the Service, including without limitation features that prevent or restrict use or copying of any content or enforce limitations on use of the Service or the content therein.


C. Discretional Rights

College Committed reserves the right to terminate a User’s access the Platform, if they turn out to be repeated infringers. College Committed may, in its sole discretion, initiate inquiries of abuse of misbehavior of any user, whether by breaching the terms regarding content upload(s) or general behavior terms explained bellow, in the “Users” section.

The reserved rights in case of violation of these terms include:

  • Deletion of User submission or Upload
  • Temporary or permanent bans on some functionalities of this Service
  • Temporary or permanent bans from accessing College Committed ’s Website
  • Initiating legal proceedings against the individual or entity involved in penal behavior against the functionality of this service under U.S. law.

Please note that Interactions are your own sole responsibility whilst using this Service. If you are experiencing spams, nuisance or otherwise unpleasant behavior from other Users of the Service, please report such occurrences to our Administrative or Support Staff.

                D. Disclaimer on Law Enforcement and Inquiries by State Authorities

College Committed may disclose your personal information in the minimal range which is necessary under applicable law, in connection with any current or future legal proceedings in order to constitute or defend its respective legal rights. College Committed may further disclose your personal information upon request of State authorities, in a range and manner prescribed by applicable law. In the event of any disclosure, College Committed WILL NOT disclose more information than the minimal range which is prescribed by governing law. College Committed reserves the right, but not the obligation to initiate personal inquiries of potential abuse and/or misbehavior personally or upon filed reports or complaints, regarding any Users’ activity. Any investigation or inquiry will be at the sole discretion of College Committed and it will include any steps that College Committed finds appropriate. Note that these steps may include disclosing User conduct to one or more entrusted parties.

3. Privacy Practices

                A. Information Collection and Range of Use

Any forms you are to fill will notify you of the range of publication of specific personal information details. Keep in mind that sensitive information cannot be published on the Internet. You hereby agree to cross-borders transfers of your information. Any personal information necessary for the registration and/or your identification while entering into contract (acquiring) a specific service provided by College Committed trough this App will be used only for the purposes of registration, identification and/or enabling other communication functionality.

                B. Communications from the Service

College Committed will may occasionally, depending on your consent to do so, send information on products, Services, Special deals, promotions or Newsletters You have subscribed to. You may choose not to receive these types of communications by Opting Out. For more information, please read further to the “Consent and Opt-outs” subsection. College Committed may also send you service-related announcements on rare occasions if it’s necessary to do so. These communications are NOT PROMOTIONAL in nature. College Committed may also utilize Third-party e-mail delivery systems to contact you and provide you information via e-mail. These companies do NOT retain, share, store or use personal information for any other purposes.

                C. Communications from Users on the Service

The Service may help coaches communicate with other Users by means of email messages. Users are not permitted to send email messages to any user with whom you do not have a relationship and from whom you have not received explicit consent to send such messages. If you send an email message through the Service, YOU REPRESENT AND WARRANT TO US THAT EACH PERSON YOU MESSAGE HAS CONSENTED TO RECEIVE EMAIL MESSAGES FROM YOU. The Service reserves the rights, but not the obligation of inquiries of breaches of this Subsection. If such a breach occurs, Users that have been contacted without permission should report such an occurrence to our Administrative or Support Staff. Full discretional rights (SECTION NUMBER) are reserved towards the User in breach of this Subsection. You further agree to all forms of communication from registered Users on the Service, provided that no type of information is to be of Nuisance of Spamming. If you have just cause for wanting to limit the communication towards you, contact us for opt-outs, or call the national do-not-call agency. By signing up for College Committed and providing your mobile number, you agree to receive text and email messages from members of the service. Additional charges from your wireless provider may be billed, according to the Terms agreed between you and your wireless provider.

                D. Scope of Use of information Upon Registering

In order to use our Service, filling a registration form is required. During registration, you will be required to give contact information including, but not limited to: your e-mail address, residence, name and surname, billing credentials etc. Upon registering on the Service, you agree to: - provide true, accurate, current and complete information If, after investigation, College Committed has reasonable grounds to suspect that any user's information is untrue, inaccurate, not current or incomplete, College Committed may suspend or terminate a user's account and prohibit any and all current or future use of the College Committed application/sites (or any portion thereof) by that user other than as expressly provided herein; - The responsibility of maintaining the confidentiality of account login and password information and for all activities occurring there under control; - Give College Committed the right to publish any and all information provided as part of College Committed registration, to facilitate social networking among its members; - Receive a sales or service call from our employees, partners or independent contractors, notwithstanding your registration for National Do Not Call agency. This information is used primarily to get connected to Our Users, offering Content and Services for which they have expressly stated their interest in. Information is stored utilizing cookies, log files, clear gifs and similar techniques to create a custom profile tailored to your preferences. Tailored promotions are also tied to your personal information. College Committed will not share your personal information without your previous consent. College Committed collects personal information from its Users at several locations on its Website.

                E. Further Use of Your Personal Information

Personal information collected by College Committed is primarily used to customize Your User Experience this may include personalized Services, communications and other Services. Personal information may also be utilized to deliver you personalized advertisements. Advertisers however do NOT have access to your personal information. Advertising is realized in the form of banner ads or promotional e-mails. Promotional e-mails and other forms of marketing communications may be manually set according to your preferences. For more information, please see the “Consent and Opt-Outs” and “Log files and Cookies” Subsections. Without allowing for access to some of your personal information, some of the functionality of the app may be limited.

                F. The COPPA Act

We respect the statutory provisions of the Children’s Online Privacy Protection Act. Please note that the Federal Trade Commission, US‘ Consumer protection Agency enforces the Children’s online Privacy Protection Act, which are to ensure the privacy and safety of children while utilizing internet-related services. Parents of minors are to review, delete, manage or refuse with whom their child’s information is shared by utilizing the “consent and opt-outs“ subsection, or by means of direct contact towards the College Committed Support Team. Under the COPPA act, we are not to be considered as a Service which markets to children. We do NOT, in any way, collect personal informaiton from children under 13 whatsoever. We advise parents on keeping their third-party authorized platforms for purchases of this App strictly confidential, and to acquire the App or related In-app purchases or Extras personally, for the child. Any references in which this Privacy Policy governs the usage of personal information is voided when it comes to a user under the age of 13. Anonymized methods of information gathering (without limitation, to: cookies, clearpixel technology or behavioral tracking algorhythms) is to be used towards users which have met the legal requirements and expressed strict consent to, and with full legal capacity and understanding of the possible effects of such consent.

                G. The CANSPAM Act

The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations. We strictly collect your e-mail address so we may: - Send information, respond to inquiries, and/or other requests or questions; - Process orders and to send information and updates pertaining to orders; - Send you additional information related to your product and/or service; - Market to our mailing list or continue to send emails to our clients after the original transaction has occurred. We comply to every provision in the CANSPAM act, which includes: - providing true and non-misleading subects or e-mails; - Identify the message as an advertisement in some reasonable way; - Include the physical address of our business or site headquarters; - Monitor third-party email marketing services for compliance, if one is used; - Honor opt-out/unsubscribe requests quickly. - Allow users to unsubscribe by using the link at the bottom of each email.

                H. Consent and Opt-Outs

In certain aspect of usage, Users are given the opportunity to opt-out of having their personal information used for certain purposes. Firstly, and as stated in the introductory clauses, all further usage of your personal information is subject to Your FURTHER CONSENT. You therefore have the choice of denying us access or not providing us this information, either manually within the app, or on your mobile device. Please note that some aspects of the functionality of this App depends on your providing of your personal information or location. If, at any time, you would like to unsubscribe from receiving future emails, you can email us directly, or submit a request on a dedicated area of our Website or App. You may also request to unsubscribe form future e-mails by following the instructions at the bottom of each email. Upon doing so, you will be promtly removed from ALL corespondense you have been subscribed to.

                I. Log Files, Cookies and Clear Pixels. Behavioral Tracking Mechanisms

Certain information is gathered and stored in log files. This information includes the IP address, browser type, ISP, OS, Date and Time Stamp and Clickstream data. This information does NOT identify individual Users nor can closely distinguish Users. This information is utilized to administer the site and to track Users’ movements across the App. Cookies are small pieces of data stored locally on Your Device. Session ID cookies are used and utilized to maintain Users’ subscriptions and accounts. Information stored in cookies cannot closely distinguish Users. Session Cookies are utilized to improve navigation on our site. We do not recommend restriction of cookies, because we utilize them to improve your user experience. Clear pixels are a part of a tracking technology, in order to track the movement of the Users within the app. In contrast to Cookies, Clear Gifs are not stored on your device. College Committed does not tie movement or usage data to personal information in any way whatsoever. Third party advertising services, providing you with targeted advertisements according to your preferences, according to your behavior and searches on the Internet. We may also utilize analytic software or algorithm in order for us to gain statistics gathered from users on our App. The information advertising services or analytic software or codes collects is not, in any way, relatable to your identity, and we do not believe that it may be used to disclose your identity. Third-party behavioral tracking methods are used on our Service. Please note that any information is not relatable to any user, whether underage or of age, and we do not believe it could be used to disclose your identity.

                J. Security and Fair Information Practices

Encryption technology is utilized to safely store your personal information. College Committed follows accepted industry standards during the process of submission, transmission and acceptation of personal information. No method so far is 100% accurate, but we are committed in caring for the information you share with us in the best way possible. All of our employees are kept up to date in regards of privacy practices. Personally identifiable information are kept in a secure environment. If you have any questions in regards to our Security policy, please do not hesitate to contact us. We, as a Service, oblige ourselves to notify you via e-mail, the Website or other recognizable aspect of our App in the unlikely case of a data breach as soon as possible. You are entitled to seek redress from us in the case we do not inform you of a security breach which was within our scope of knowledge.


4. Orders and Payment

A. Billing Policies

Certain aspects or functionalities of the Service may request a fee prior to authorizing User to use these functionalities. College Committed reserves the right to amend fees, add fees or charges, change charges for existing services and introduce new functionalities to the service. Any change of our pricing list is to be available on our Website, and the full price of each service which is to be purchased is to be displayed in the price breakdown displayed upon checkout.

                B. Cancellation and Refund Policy

It is the Users’ sole responsibility to terminate the Account or any paid Subscription, add-on or other licensable element. Please note that NO Refunds are to be issued for cancellation or termination of account with an active subscription plan, add-on or licensable element.

                C. Payment Information and Taxes

All information in connection to a purchase must be current, accurate, complete, non-fraudulent and non-misleading. The Charges are to be paid via the preferred payment protocol which is to be chosen prior to checkout. You must provide truthful, current, accurate, complete and non-misleading information about your Billing Account and to update information in order to keep this information current. Any change is to be notified to the Service.

COLLEGE COMMITTED DOES NOT UNILATERALLY PROVIDE ANY EXPRESS OR IMPLIED TERMS, REPRESENTATIONS, WARRANTIES OR CONDITIONS.
